NAR Rival Seeks Agents For Possible Class Action Over Clear Cooperation

The American Real Estate Association is soliciting real estate agents impacted by the National Association of Realtors’ Clear Cooperation Policy, which requires listing brokers to submit listings to their MLS within one business day of marketing a property publicly. This has led to debates and potential antitrust litigation.

Agents who have faced fines or other impacts due to the policy may be eligible to join a class action lawsuit against NAR. The American Real Estate Association is collecting information from affected individuals. If you have been impacted, fill out the form here.

NAR has stated that they do not comment on threatened litigation and will discuss the Clear Cooperation Policy at a meeting in late October. The American Real Estate Association has launched a petition to urge NAR to eliminate the policy.

Jason Haber, co-founder of the American Real Estate Association, mentioned that they are in the gathering information phase and responding to agents’ frustrations with existing industry practices. They are exploring the possibility of a class action lawsuit but have not made any decisions yet.

The focus is on understanding how many agents have been affected by the Clear Cooperation Policy and advocating for their interests as a new trade group. The potential for legal action is being considered, but the next steps are still to be determined.
