Longbridge, Mutual of Omaha granted delay in reverse mortgage marketing lawsuit

Mutual of Omaha Granted Extension by Judge Sabraw

An extension was granted by Judge Dana Sabraw to Mutual of Omaha, allowing more time to respond to Longbridge’s move for a preliminary injunction. The hearing date was also pushed to April 14, with all requests being approved earlier this week.

The filing indicated that Mutual of Omaha and its co-defendants plan to present their own expert witness to provide rebuttal testimony against Longbridge’s allegations. Both parties agreed that an extension was necessary to organize a substantive response, which was deemed as showing “good cause” by Sabraw.

The ongoing dialogue between the two lenders in “meet and confer discussions” is part of the discovery process under California law. These discussions require a reasonable and good faith attempt at resolving issues informally.

In September 2024, Longbridge filed a lawsuit alleging that Mutual of Omaha’s websites were deceptive and in violation of RESPA and FTC guidance. Discussions regarding a potential settlement are ongoing, with Mutual of Omaha filing a countersuit last month.

Longbridge’s preliminary injunction filing claims that Mutual of Omaha’s websites artificially inflate scores and are fatally deceptive. Mutual of Omaha denies these allegations and asserts that Longbridge is targeting their business unfairly.
