Over 10 million homesellers have received or will receive notices informing them that they may be eligible to receive payment from proposed commission settlements involving several real estate brokerages.
JND Legal Administration, the company tasked with overseeing administrative duties related to the commission lawsuit known as Gibson, has sent out more than 10 million postcard notices and over 27 million email notifications to potential class members since March, as stated in additional legal documents provided to Inman by JND.
JND is also running advertising campaigns across various media channels to reach consumers who may be eligible to file claims, emphasizing the extensive scope of the settlements and the fact that they are progressing outside the courtroom.

The notice states, “If you sold a home and paid a commission to a real estate agent, then you may be part of class action settlements.” Over 700,000 postcards have already been returned as undeliverable.
Homesellers have until May 9, 2025, to submit a claim form by mail or online at www.RealEstateCommissionLitigation.com. Alternatively, they have until Oct. 3 to opt out of the settlements or raise objections.
A final public hearing regarding the settlements with Compass, Real, Redfin, Realty One, @properties, Douglas Elliman, Engel & Volkers, HomeSmart, and United Real Estate is scheduled for Oct. 31.
Not all brokerages mentioned in the Gibson suit have reached settlement agreements, and the overall settlement amount may increase in the coming weeks. EXp Realty is the largest firm that has not yet reached a settlement agreement.
Homesellers may be eligible if they listed their homes in specific areas and timeframes listed below:
- On an MLS in Alabama, Georgia, Indiana, Maine, Michigan, Minnesota, New Jersey, Pennsylvania, Tennessee, Vermont, Wisconsin, or Wyoming between Oct. 31, 2017 and July 23, 2024
- On an MLS in Nevada between Jan. 15, 2018 and July 23, 2024
- On an MLS in Arkansas, Kentucky, or Missouri between Oct. 31, 2018 and July 23, 2024
- On an MLS in California between Oct. 2, 2019 and Jul 23, 2024
- On an MLS anywhere in the United States, other than in the states listed above between Oct. 31, 2019 and July 23, 2024.
Collectively, the brokerages mentioned above have agreed to pay over $110 million in settlements.
The total amount surpasses $730 million, including settlements from the National Association of Realtors, HomeServices of America, Keller Williams, and other parties involved in the case. Plaintiffs’ attorneys may receive up to 33.3 percent of the total settlement, in addition to reimbursement for any out-of-pocket expenses accrued during the legal proceedings.
